Why am I so careful to call the United States a Constitutional Republic rather than simply a democracy?

Tonight we go directly to the Constitution, Declaration of Independence, James Madison’s Federalist Papers and one extraordinary Supreme Court decision to answer that question.

Democrats routinely warn that “our democracy” is endangered — but America’s constitutional architecture was deliberately built to place limits on majority power. The Founders feared tyranny by government, but they also feared something we rarely discuss today: tyranny exercised by a political majority against a minority.

The distinction matters.

America absolutely contains representative-democratic institutions. We vote. We elect representatives. Government derives legitimacy from the people.

But elections don’t determine the limits of your rights.

The Constitution does.

And Justice Robert Jackson summarized the principle brilliantly in 1943: fundamental rights “may not be submitted to vote.”
